No. 1716 DISPOSAL OF PROPERTY RESOLUTION - 387 Old Junior High/Glacier Gateway Elementary Building WHEREAS, Section 20-6-604, Montana Code Annotated, provides in pertinent part: (1) Whenever the trustees of a district determine that a site, building, or any other real or personal property of the district is or is about to become abandoned, obsolete, undesirable, or unsuitable for the school purposes of the district, the trustees may sell or otherwise dispose of the real or personal property. If a decision to sell or dispose of property is made, the trustees shall adopt a resolution to sell or otherwise dispose of the district real or personal property because it is or is about to become abandoned, obsolete, undesirable, or unsuitable for the school purposes of the district. (2) The resolution may not become effective for 14 days after the notice required in subsection (3) is made. (3) The trustees shall provide notice of the resolution in the manner required for school elections in 20-20-204. WHEREAS, the Columbia Falls School District presently owns certain real property known as the old Junior High/Glacier Gateway Elementary located at 440 4th Avenue West, Columbia Falls and more specifically described as: Southern Boundary - 7th Street Northern Boundary - 5th Street Eastern Boundary - 4th Avenue West Western Boundary - Administration Building running easterly as moving south WHEREAS, an election was conducted October 8, 2019 that approved the construction of a new building for Glacier Gateway Elementary, which has led to the termination of the use of the old Junior High/Glacier Gateway Elementary building for school and district purposes; WHEREAS, pursuant to Section 20-6-604, Montana Code Annotated, the Board of Trustees of Columbia Falls School District, hereby determines that the old Junior High/Glacier Gateway Elementary building is obsolete, undesirable, or unsuitable for school purposes; NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of Columbia Falls School District intends to sell the Property in full compliance with Section 20-6-604, Montana Code Annotated. BE IT FURTHER RESOLVED, the Board of Trustees of Columbia Falls School District authorizes the Superintendent to place the old Junior High/Glacier Gateway building on the open market and take action to effectuate a conveyance agreement with a qualified buyer subject to the approval of the Board of Trustees. BE IT FURTHER RESOLVED, that the conveyance agreement may contain terms that among others limit the scope of the use of the real property and provide for a right of first refusal as approved by the Board of Trustees. BE IT FURTHER RESOLVED that all monies resulting from the sale of the old Junior High/Glacier Gateway Elementary building shall be deposited in the Multi District Interlocal Agreement Fund as provided in Section 20-6-604, Montana Code Annotated. BE IT FURTHER RESOLVED, the resolution shall become effective fourteen (14) days after the notice required in accordance with Section 20-6-604, Montana Code Annotated has been made and no taxpayer appeals this Resolution by filing a verified petition with the Clerk of the District Court setting out in detail the objections to the adoption of the Resolution or the disposal of the property and serving a copy of such petition upon the School District.
